Jeff Jacoby: The abusers of eminent domain: "Nor shall private property be taken for public use without just compensation."

Governmental power has to be as tightly restricted and clearly defined as possible. A small increase in power must still be fought, even when the action being taken seems justified or perhaps trivial. The reason for this is that when that justification is made and action taken, it can lead to justification for more and more power. This article outlines a perfect example. Government influence and control should be as limited as possible. Period.

This train of thought seems to discredit your later post regarding Jacoby. If the government should stay out of people's lives as much as possible, does it not make sense that they would stay out of the relationships consenting adults desire to be within?
